SOUTH HERO DEVELOPMENT REVIEW BOARD                                             June 28, 2023

 

Members Present: Tim Maxham (Chair); Doug Patterson (Vice-Chair); Nate Hayward; Mike Welch; Liza Kilcoyne; Jim Brightwell; Ellie Reid (via Zoom)

Others Present: Mike Gammal; Michele Gammal; Martha Taylor-Varney (ZA)

 

7:00PM – T. Maxham opened the hearing and members were introduced.

There was none.

 

Final Plat Review for 3-Lot Major Subdivision (23-42-RT466) – Keeler Bay Associates

The warning was read and interested persons sworn in.  Mike Gammal presented as the Applicant.  He explained that the requested corrections made at the Sketch Plan hearing had been added to the final subdivision plat.  The eastern boundary of the proposed Lot 4 had been curved slightly to allow for a 10-ft. setback from the event deck to the boundary.  The final size for Lot 4 is 0.55 acre.  Lot 3 (the food truck lot) has been reduced by .08-acre to 1 acre.  Lot 1 (Marina lot) is reduced by .42-acre to 3.41 acres. Mike told the Board that, at this time, he had no intention of building the proposed garage on the new lot.  T. Maxham asked about the reallocation of septic by reducing the allocation to house sites on Lot 2.  Mike Gammal said that this was to allow for an increase to 52 seats on the deck and additional septic for an increase in dock slips. The garage will have only a composting toilet and non-potable water from a spigot.  At this time there is no planned use for the additional structure on the new lot.  If other than a private garage is proposed, the Applicant will come back before the Board for additional review.  Mike explained that he is trying to respond to the market, so his plans may change.  His intent is for a personal garage.  He won’t change anything without going ack to the Board.  M. Welch asked about the 50-ft. right-of-way from RT 2.  Will the access to Lot 4 be from this ROW?  Mike said this has not been determined yet.  There will be no public vehicle access to the event deck.  J. Brightwell asked Mike why he wanted to create another lot.  Mike said that if the marina is ever sold, there won’t have to be any additional review from the Town [subdivision].

Four waivers were requested by the Applicant:

  1. Waiver from providing a traffic generation study;
  2. Waiver from providing a traffic impact analysis;
  3. Waiver from providing a grading plan;
  4. Waiver from providing an erosion control plan.

Additional discussion – re waiver #4, L. Kilcoyne noted that conditions should include the requirement to follow best practices.

 

  1. Welch moved to allow the waivers; J. Brightwell second. All in favor.

 

  1. Patterson oved to accept the final subdivision plat as complete; M. Welch second. All in favor.

 

  1. Maxham closed the hearing at 7:37PM.

 

New Business

Michele and Mike Gammal asked the Board if there had been any input from the Board or the public on the Rest Stop, the food truck at the Keeler Bay Associates Lot 3 location.  They said that the deck had been expanded slightly to the east to create an area for musicians that will aim music away from the lake.  Also, some of the rocks marking the parking area on Lot 3 have been moved to allow expansion of parking and to block off the picnic tables from the parking area.  The Board had no concerns, nor have there been any complaints from the public.

 

Review of May 24, 2023 Minutes

  1. Kilcoyne moved to accept the minutes from May 24, 2023, with corrections; M. Welch second. All in favor.

 

Administrator’s Report

  1. Upcoming schedule:

July 12

  1. Brew Pub amended conditional use (expand hours) and food truck CU/SP review.
  2. Setback Waiver at 19 Allen Point Rd.

July 28

  1. 2-lot subdivision administrative review at 50/60 Ferry Rd.
  2. Appeal of Notice of Violation at 238 US RT 2.

 

  1. Parts of the HOME Act become effective on July 1, 2023, allowing duplexes (2-household dwellings) to be reviewed the same as single family homes. Currently, 2-household dwellings require conditional use review in the Shoreland, Conservation, and Rural Residential zoning districts.  After July 1, 2023, this will no longer be required.

 

  1. Zoning 101 will continue Thursday, June 29 at 6PM at the Town Office.
