Selectboard Minutes
Regular Meeting of February 13, 2017
South Hero Town Hall, Monday 7:00 PM

Board Members Present: Jonathan Shaw, Skip Brown (also Board Secretary), Anne Zolotas, Carol Tremble,
George Rice
Board Members Not Present: none
Others Present: Sharon Roy, Town Clerk. Martha Taylor Varney, Administrative Assistant. Also see sign in sheet.

1. Called to Order:
-The meeting was called to order by Chairman Shaw at 7:00 pm.
-He asked for a moment of silence in the memory of Elinor and Carolyn Lawrence who perished in a fire on February 9.

2. Adjustment to Agenda:
-Angolano & Co. has cancelled. No new date is rescheduled yet.

3. Minutes:
– Anne Zolotas made a motion to accept the minutes of the meeting of January 23, 2017 as written. The motion was seconded, all in attendance so voted and the motion carried.

4. Administrative Assistant Report:
A. A written report was submitted. A hard copy with discussion points can be seen in Town Hall filed with these minutes or on www.southherovt.org.
B. Keeler Bay Marina and Campground are applying to the Army Corps of Engineers to extend the marina docks farther into the Lake and to increase the number of slips to 120. The Army Corps sent a letter to the Town and has given until Feb. 17 to respond. The consensus of the Board is to write a letter with concerns, have the Chairman sign it, and send it by the deadline.
C. Carol Tremble made a motion to have the Planning Commission contract for landscaping at the Park & Ride with the remaining balance of the State Grant. The motion was seconded, all in attendance so voted and the motion carried.

5. New Business:
A. One letter of interest for the opening on the Development Review Board (DRB) was received. Carol Tremble made a motion to appoint Liza Kilcoyne as alternate to the DRB for a 1 year term. The motion was seconded, all in attendance so voted and the motion carried.
B. George Rice made a motion to sign and approve the DRB Rules of Procedures and Conflict of Interest Policy. The motion was seconded, all in attendance so voted and the motion carried.
C. Mike Guernsey wishes to resign as the Town representative to the Northwest Regional Planning Co. (NRPC). His term is up in April. Martha will write an ad for letters of interest to be placed in the Islander and also on Front Porch Forum.

6. Old and Ongoing Business:
A. South Street reconstruction project from Landon to Martin Roads updates: The bids for South Street are submitted. The low bid is approx. $1,427,000 and the high bid is approx. $1,895,000. The State “vets” the bids, and assuming that the low bid meets the necessary parameters, the State will approve it. Carol Tremble made a motion to have the Selectboard chairman sign the contract of the State approved low bidder when it comes in. The motion was seconded, all in attendance so voted and the motion carried.

7. Other Business:
A. Anne Zolotas made a motion to sign orders 17-17 and pay the bills associated with this order. The motion was seconded, all in attendance so voted and the motion carried.
B. George Rice made a motion to approve the liquor license renewals that have been received so far.
They are: Snow Farm Vineyard, Jolley Short Stop and Keeler’s Bay Variety. The motion was seconded, all in attendance so voted and the motion carried.

C. In 2012 the Town received a license application from the State Fish and Wildlife department for the Roy Marsh Trail. The State has no record of receiving that application, which did not have to be signed by the Town. The State is now saying that the terms of license agreements have changed since 2012 and will decide whether to accept the lost license. More info to follow.

8. Public input:
A. The “meet the legislators” was held tonight (Feb. 13). David Hobbs and Terry Delano attended that meeting and advised the Board that Sen. Mazza will be willing to look into the speed limit and signage issue along Route 2 at the east side of Town. The consensus of the Board is to have Terry resend info that was submitted to the State last fall to Sen. Mazza.

9. Adjournment:
-Carol Tremble made a motion to adjourn 8:00 pm. The motion was seconded all in attendance so voted and the motion carried.

Administrative Officer’s Report to Selectboard February 13, 2017

Discussion Items:
1. Park and Ride: The Planning Commission has decided to use the balance of the grant money for landscaping the facility. They will put together a proposal for SB approval for your Feb. 27 meeting.
2. South Street – Bid has been closed on VTBid system.
3. DRB Alternate – received only one applicant for open Alternate position: Liza Kilcoyne. Recommend appointment.
4. Selectboard is asked to consider ZA’s attendance at a future Association of State Floodplain Managers’ FEMA 4-day Training course (No tuition but responsible for own travel, lodging, and meal expenses).
5. Keeler Bay Campground and Marina — Received permit application information from VTrans and Army Corps, and an amended Wasterwater permit for Keeler Bay Marina as part of a request to expand the marina from 60 slips to 120. Army Corp asked for objections within 15 days of the date of their letter to their intention to grant a Letter of Permission to the Marina. As the DRB has yet to receive an application for review (so does not yet have jurisdiction on the matter), I have been told by Michael Adams of the Corps that I can write a letter listing concerns that can still be considered when the DRB’s begins review of their application. He made clear that the Army Corp’s Letter of Permission does not trump the Town’s permits, and the DRB’s decision and conditions cannot be dictated by the Corp’s approval. Will have letter drafted and sent by mid-week (deadline is Feb. 17).

Planning Commission: Continuing to meet with NRPC for Development Regulations updates.

Development Review Board: First hearing scheduled for February 22 2017. Anticipate the schedule for hearings will become very active soon.
