SOUTH HERO DEVELOPMENT REVIEW BOARD                                               May 14, 2025

 

Members Present: Tim Maxham (Chair); Doug Patterson (Vice-Chair); Nate Hayward; Liza Kilcoyne; Mike Welch (via Zoom).

Others Present: Angelina and Brendan Beaudoin; Darin Orr; Matt Bartle; Don Bedard (via Zoom); Jason Lee (via Zoom).

 

7:00PM – T. Maxham called the meeting to order.  The Board was introduced.

 

Changes to the Agenda

There were none.

 

Public Input

No public input.

 

Site Plan Amendment – Pest Pro/Jon Quackenbush (#25-58-RT238), to expand parking lot to 12 spaces.

7:02PM — The hearing was opened, and the warning was read. T. Maxham announced that the Applicant had requested a postponement of the hearing due to a family medical emergency.

 

**D. Patterson moved to recess the hearing to Wednesday, May 28 at 7PM; N. Hayward second.  All in favor.

 

Conditional Use/Site Plan Review – Two Heroes Brew Pub (#25-57-RT252), for a food truck and request to hold special events.

7:04PM – The warning was read and interested persons sworn in.  Matt Bartle and Darin Orr presented.

 

Matt Bartle told the Board that they wish to have a food truck on the premises when the kitchen is not open and, in addition, to supplement the kitchen on busy nights.  They considered 3 locations for the food truck – Location #1 in a space by the lawn near the patio; Location #2 near the northeast corner of the pub; and Location #3 on the north side of the building near the current dumpster location.  There will only be one food truck at a time.  Both Matt and Devin prefer Location #1.  The other 2 locations would require patrons to walk across the parking lot.  There are now 22 additional parking spaces.  4 to 5 more will be put in once the updated stormwater permit is issued.   The proposed storage building has yet to be built, allowing for the additional parking spaces that will eventually be created later.

Maxham asked about the request for special events. Matt told the Board that they would like to have outside music for up to 8 events.

An HC parking space would need to be temporarily relocated if the food truck was at Location #1, resulting in 2 HC spaces in front of the pub but across the parking lot, without access directly to the sidewalk. L. Kilcoyne and T. Mullen will check if the hash marks, denoting a loading zone, must be shown between the 2 spaces.  T. Maxham stated that he prefers Location #1 over the others.  L. Kilcoyne asked where customers would line up at the food truck in that location.  Matt stated that the food window would be on the side or the back – not toward the parking lot. Customers would line up on the lawn.  L. Kilcoyne — Will music and a food truck create more traffic and attract more people than the wastewater permit allows?  Matt said he felt it would not create more traffic, and that septic capacity exceeds the number of customers.  N. Hayward confirmed that the use so far has been only ¼ of the mound’s capacity.   Would use of a food truck coincide with music events?  Yes.

 

Public Comment

Jason Lee stated that he supports both proposals.

Angelina Beaudoin told the Board she has concerns about noise.  She wants to be supportive but has concerns about privacy.  Could a fence or hedge be put in to mitigate the noise?

Brendan Beaudoin felt that the proposed outside music is a concern.  The indoor music is loud now when the doors are open.   There are a lot of people outside.  Their house is 200 feet from the pub, and it seems that the number of people is already over capacity.  There is a lack of parking and concerns about traffic made him feel unsafe when trying to pull out of their driveway.  At nighttime headlights shine into their front windows making privacy a concern.  Sound echoes off the library building.  They can’t enjoy their home – inside or back yard.   The noise, traffic, and lights are overwhelming.

Angelina Beaudoin asked when the outside music would end each night. 8:30. How many events? Up to 8.  Where will the music be on the property?  On the patio. Angelina was concerned about her kids’ safety.  Matt asked if they would allow him to plant careening on their property.  May be too far away to be effective. Angelina asked if arborvitae could be placed on the pub’s property on the RT. 2 side of the business.

 

Board Questions Continued

Kilcoyne asked if the Applicants had a preference for location of the food truck. Location #1. The dumpster in the back will eventually be moved, so Location #3 could possibly work, and it is accessible by an existing path. But that option is not available right now, although it is further from the Beaudoin home.

Hayward asked if temporary partitions could be placed on the south side of the patio. Yes, that could be considered.

Maxham asked if the band could relocate to alleviate the neighbors’ concerns. That could be possible. Perhaps behind the building (north) with a temporary platform.

Maxham suggested the Board conduct a site visit. T. Mullen recommended it be at a time that the pub is not open.

**M. Welch moved to recess the Tuesday, May 27, 2025 @6PM at Two Heroes Brewpub for a site visit; T. Mullen second.  All in favor.

**L. Kilcoyne moved to recess the hearing to May 28, 2025 @7PM at the Town Office; N. Hayward second.  All in favor.

 

Old Business

The Board continued to review the draft DRB Rules of Procedure.  No action taken.

 

Review Meeting Minutes of April 23, 2025

**L. Kilcoyne moved to accept the minutes of April 23, 2025, with corrections; M. Welch second.  All in favor.

 

Administrator’s Report

-Upcoming schedule – May 28, 2025: Site Plan amendment request by Keeler Bay Associates.

-The Zoning Office will be closed June 25 through July 1, 2025.  There will be no hearings scheduled for the Jue 25 meeting.
