MAY 24, 2017 MEETING

MINUTES

 

7:00 p.m.   Hearing: 17-67-WP006/Island Mini-Storage – Conditional Use Review:

A.    Board members in attendance

C.    Motions

a.      The hearing was opened by Tim Maxham at 7:02 p.m.

b.      Doug Patterson read the warning published in The Islander on 5/9/17.

c.      Tim Maxham gave the oath.

d.      Tim Maxham closed the hearing at 7:26 p.m.

D.    Discussion

a.      Martha Taylor-Varney noted a correction to the warning that this was the 4th building, not the 3rd. This correction was sent to all abutters.  

b.      Bill Barron said that he came before the ZBA in 2007 asking for 3 additional buildings. There was 1 existing building and there is space for a total of 4.

c.      Steve Robinson owns the land that Island Mini Storage leases.

d.      In 2007, the ZBA approved the additional buildings for a total of 4, but with the condition that they all are built within 5 years, or by 2012.

e.      Only 2 of the 3 additional buildings were built in that timeframe. Bill Barron would like to build the 4th building now.

f.       The building will not exceed 2400 sq. ft. It may be downsized in order to allow sufficient room for vehicles an adequate turning radius. It will be the same color and design as the existing 3 buildings. It will be 20 ft wide and either 100 ft or 120 ft long.

g.      This building will have the same type of lighting as the existing buildings which is a 10 W LED, downcast light. There may be up to 4 lights on the ends of the building. The east side will have 3 or 4 LED 10W lights.

h.        The access to the buildings will be on the West side and each end. There are large boulders on the east side of the property so it is not possible to drive and turn around on that side of the building.

i.       There are 14 on-site cameras for security.

j.       No additional grading is needed. There may be slight changes to the drive. A slab will be added for the building to be placed on.

k.      There is a septic easement along the east side of the property for the drug store. So there will be no expansion on that side of this lot.

l.       All slabs will be at approximately the same elevation.

m.    All buildings will meet the 25 ft setback requirements.

n.      Bill Barron said he plans to build as soon as he gets all of the permits.

o.      There will be a total of 15 units.

p.      There should be no change in the amount of traffic to the site.

C.    Motions

a.      The hearing was opened by Tim Maxham at 7:28 pm.

b.      Doug Patterson read the warning published in The Islander on 5/9/17.

d.      Tim Maxham closed the hearing at 8:37 p.m.

D.    Discussion

a.      Ross Brown recused himself from the hearing as he is the applicant. Lisa Kilcoyne, alternate, took his seat.

b.      Ross Brown testified that the property is currently permitted for a farm stand, bakery, and a 2 bedroom apartment. He would like to expand the use to include a 50 seat restaurant.

c.      The wastewater permit is for 450 gals which he will keep. The restaurant requires a wastewater permit for 1500 gals. He will support this requirement by a leach field on his farm property.

d.      The focus of the restaurant will be farm to table, brewing hard cider from his apple trees, and he may offer the kitchen to local chefs.

e.      Ross Brown expects the traffic to be grouped up at certain times during the day rather than steady throughout the day.

f.       The lighting will be downward facing.

g.      The porch will be flipped from the Landon Road side to the west side of the building from what is already permitted.

h.      There will be a total of 30 parking spaces.

i.       Ross Brown said that he has moved the driveway on Peters Farm Rd so that it is no longer directly across from his neighbors. Cynthia Seguin asked for a clarification of where the driveway would now be located.

j.       The Board told Ross Brown that a site plan needed to show such things as: building elevations, doors, traffic patterns, pedestrian walkways, easements, lighting, and landscaping.

k.      Ross Brown wants to keep as much of the native soils as possible and not cut any grades.

l.       The foundation for the permitted building is in and the parking area has been graded and filled.

m.     It was pointed out that there might be a pinch point with the parking. Ross Brown said that would be easy to change.

n.      The 50-seat restaurant would be available for 2 meals a day, 7 days a week, from 10 a.m. to 10 p.m.

o.      Jeff Seguin said that he was concerned with the traffic on Peters Farm Rd. Ross Brown responded that he expected most of the traffic to use Landon Road. The delivery vehicles would be directed to use Landon Rd.

p.      Jeff Seguin also said he was happy the property is being cleaned up.

q.      Ross brown said that he thought there would be less traffic with a restaurant than with a farm market and bakery. He does expect it to be mostly seasonal traffic.

r.       Cynthia Seguin pointed out that there was no liquor in the current permitted use. She is concerned about the traffic and incidents due to alcohol consumption. Ross Brown explained that there would not be a bar, just a couple of chairs for waiting. He would be selling hard cider and beer only.

s.      Ross Brown does not expect to have any events take place on the property at this time. He recognized that he would have to come back for a change in use to include events should he decide to have any.

t.       Sherry Corbin asked if the Peters Farm entrance could be made less desirable and hence people would use the Landon Rd entrance. The driveways on Peters Farm Rd and Landon Rd would have both entrance and exit lanes.

u.      Ross Brown said he already has access permits for the 2 driveways and a 24 ft culvert has been installed.

v.      There is a farm road that leads off the property at the south side which goes to Ross Brown’s farm property. He has been using it for several years to access the rear of his farm.

w.     Tim Maxham closed the hearing at 8:37 p.m.

b.     Motion was made by Doug Patterson, seconded by Nate Hayward, to approve the minutes as written. All so voted to approve.

c.      Motion was made by Paula Delano, seconded by Ross Brown, to adjourn the meeting at 8:50 pm and go into a deliberative session.  All so voted to approve.

D.    Discussion

a.      Tim Maxham opened the meeting at 7:00 pm.

b.     The Board members introduced themselves.

c.      Gareth Hunt joined the Board at 7:03 p.m.

d.     There were no changes to the agenda.

e.      Ross Brown recused himself from the second hearing. Lisa Kilcoyne, alternate, replaced him on the Board. When the hearing was finished, Ross rejoined the Board at 8:37 p.m.

f.       The minutes of the April 26, 2017 meeting were discussed. There were no corrections.

g.      There was no public input

h.     Administrator’s Report

                                                    i.     June 14th there will be 2 hearings (Sketch Plan and Conditional Use) and 2 deliberations

                                                  ii.     June 24th there will be 2 hearings (final plan and request for variance) and 1 deliberation

                                                 iii.     July 12th there will be 2 deliberations. At this time, there are no hearings scheduled.

                                                 iv.     August 9th there will be a Site Visit at 6 pm and at 7 pm there will be a hearing (site plan and conditional use review).
